These Terms of Service ("Terms") govern your use of echoeslabmusic.com (the "Site") and any products or services offered by Echoes Lab ("we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

You agree to use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

> digital_products

When you purchase a digital product (such as an audio plugin or software tool) from Echoes Lab, you receive a limited license to use the product, not ownership of the product itself.

License grant:

• →You are granted a personal, non-exclusive, non-transferable license to install and use the software.
• →Each license key permits activation on up to 3 (three) machines that you own or control.
• →The license is perpetual for the version purchased. Major version upgrades may require a new purchase.

Restrictions:

• →You may not redistribute, sublicense, sell, resell, or share your license key or the software with any third party.
• →You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the software.
• →You may not modify the software or create derivative works based on it.
• →You may not remove or alter any proprietary notices, labels, or marks on the software.

Audio output you create using our plugins is yours. We claim no rights over music, sounds, or other creative works you produce using our software.

> merchandise

• →All merchandise orders are subject to availability. We reserve the right to limit quantities or refuse any order.
• →We make reasonable efforts to display product colors and details accurately, but we cannot guarantee that your display accurately reflects the actual product.
• →Risk of loss and title for merchandise pass to you upon delivery to the carrier.

> payments

• →All payments are processed securely by Stripe. We do not store your payment card details.
• →Prices are listed in US Dollars (USD) unless otherwise stated.
• →We reserve the right to change pricing at any time. Price changes do not affect orders already completed.
• →You are responsible for any applicable taxes, duties, or fees associated with your purchase.

> refund_policy

Digital products:

Due to the nature of digital goods, all sales are generally final. However, if you experience a technical issue that prevents the software from functioning as described, contact us within 14 days of purchase and we will work to resolve the issue or provide a refund at our discretion.

Merchandise:

Merchandise may be returned or exchanged within 30 days of delivery, provided items are unused and in their original condition. Contact us at [email protected] to initiate a return. Shipping costs for returns are the buyer's responsibility unless the item arrived damaged or defective.

When you submit content to us (such as a guest pitch via our /contribute form), you grant Echoes Lab a non-exclusive, worldwide, royalty-free license to use, edit, publish, and display that content in connection with our /log publication and related promotional materials.

• →You represent that you have the right to submit the content and that it does not infringe on any third-party rights.
• →We may choose not to publish submitted content at our sole discretion.
• →Published contributions will be credited to you unless you request otherwise.

All content on this Site, including but not limited to music, audio recordings, software, text, graphics, logos, and website design, is the property of Echoes Lab or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without prior written permission, except as explicitly permitted by these Terms (such as use of purchased software under its license).

> disclaimer_of_warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our software will be compatible with every hardware configuration, operating system, or digital audio workstation. We do not guarantee uninterrupted or error-free operation of the Site or any product.

To the fullest extent permitted by applicable law, Echoes Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Site or any product purchased through the Site. Our total liability for any claim arising from these Terms or your use of any product shall not exceed the amount you paid for the specific product giving rise to the claim.

You agree to indemnify and hold harmless Echoes Lab and its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Site, violation of these Terms, or infringement of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Clark County, Nevada.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

We may update these Terms from time to time. When we make changes, we will update the "Effective date" at the top of this page. Material changes will be communicated via email to newsletter subscribers. Continued use of the Site after changes constitutes acceptance of the updated Terms.
